Power to the people: Decision making and empowering the claim group

This presentation will discuss the possibilities of empowering the native title claim group to make sound and sensible decisions to minimise the risk of ‘piercing of the decision-making veil’.

Each native title group has its own dynamics and decision making is determined by a claim group’s own situation. Native title claims and native title business may be delayed or opportunities missed if decision-making processes are not clear and consistent which could leave the door wide open to challenge a claim group’s basis and authority to make decisions. Can a decision-making, process ever be prevented from being ‘pierced’?

The presentation will discuss some cases and case studies on decision making noting some positive and not so positive experiences, and methods that can be employed to minimise risks of a challenge.
