Dispute resolution in the Torres Strait: How we combined the two laws and practices

Between 2014-2017 DATSIP negotiated ILUAs throughout the Torres Strait for land to construct social houses. During PBC's consultation and consent requirements, disputes between traditional owners often arose about who was the traditional owner who had authority to speak for that land.

Mr Ned David will explain how the Magani Lagaugal (Torres Strait Islanders) Corporation RNTBC (the PBC for Iama) resolved these disputes using both their traditional laws and customs and in accordance with their rule book by establishing a Dispute Resolution Council. Representatives were selected based on criteria developed by the community.

Mr Keith Pabai will explain how the Malu Ki'ai (Torres Strait Islanders) Corporation RNTBC (the PBC for Boigu) and the Boigu community resolved disputes by mapping their traditional boundaries community colour coded their totem groups. This was then mapped with assistance from the NNTT.
