The Court ordered that the name of the applicant in the present proceeding be amended and the Register be updated.
The applicant seeks orders to replace a named deceased applicant with another person under s 66B of the Native Title Act 1993 (Cth). Griffiths J accepted the evidence that the proposed applicant is a member of the Kamu clan group of which the now deceased applicant was a member. His Honour further accepted evidence that a meeting occurred which authorised the proposed applicant to apply to the Court and replace the deceased, and that this authorisation was given in accordance with traditional decision-making processes with the consent of the proposed applicant.
Griffiths J was satisfied on the question of appropriateness.
